1. Acceptance of Terms
Welcome to Hostasks. By accessing or using our website, mobile applications, or any services provided by Hostasks, LLC ("Hostasks," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms apply to all users of the platform, including but not limited to Property Hosts ("Hosts") who seek cleaning services and Cleaners who provide cleaning services through the platform.
2. Description of Service
Hostasks is an online marketplace that connects Property Hosts with independent Cleaners for residential and vacation rental cleaning services. Our platform facilitates the booking, scheduling, communication, and payment processes between Hosts and Cleaners.
Important Notice
Hostasks is a marketplace platform only. Cleaners are independent contractors and are not employees of Hostasks. Hostasks does not provide cleaning services directly. We facilitate connections between Hosts and Cleaners but are not responsible for the quality, safety, legality, or any other aspect of the services provided by Cleaners.
3. User Accounts
3.1 Account Registration
To use certain features of our platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for all activities that occur under your account.
3.2 Account Types
- Host Account: For property owners or managers seeking cleaning services for their properties.
- Cleaner Account: For individuals or businesses offering professional cleaning services through the platform.
3.3 Age Requirement
You must be at least 18 years old to create an account and use our services. By creating an account, you represent and warrant that you are at least 18 years old.
4. Host Terms
4.1 Listing Properties
Hosts may list properties on the platform for cleaning services. You represent that you have the legal right to request cleaning services for any property you list, whether as the owner, tenant, or authorized property manager.
4.2 Accurate Information
Hosts agree to provide accurate information about their properties, including but not limited to property size, number of bedrooms and bathrooms, specific cleaning requirements, and any access instructions or restrictions.
4.3 Safe Environment
Hosts agree to provide a safe working environment for Cleaners, including secure access to the property and disclosure of any hazards, pets, or special conditions that may affect the cleaning service.
4.4 Payment
Hosts agree to pay for all booked and completed cleaning services through the Hostasks platform. Payment terms are determined at the time of booking and are subject to our Payment Terms section below.
5. Cleaner Terms
5.1 Independent Contractor Status
Cleaners are independent contractors and not employees of Hostasks. Cleaners are solely responsible for determining how to perform cleaning services, including the methods, materials, and equipment used (unless otherwise specified by the Host).
5.2 Qualifications and Insurance
Cleaners represent that they have the necessary skills, experience, licenses, and insurance to provide professional cleaning services. Cleaners are encouraged to maintain appropriate liability insurance coverage.
5.3 Background Checks
Cleaners may be required to consent to background checks as part of the verification process. Hostasks reserves the right to deny or revoke platform access based on background check results.
5.4 Service Quality
Cleaners agree to perform services professionally, arrive on time for scheduled appointments, complete all agreed-upon tasks, and maintain open communication with Hosts through the platform.
5.5 Tax Obligations
As independent contractors, Cleaners are solely responsible for reporting and paying all applicable taxes on income earned through the platform. Hostasks will provide tax documentation as required by law.
6. Fees and Payment
Fee Structure
- Hosts: Free to use. No listing fees, subscription fees, or lead fees.
- Cleaners: A service fee is deducted from each completed job. Current rates are displayed in your Cleaner dashboard.
6.1 Payment Processing
All payments are processed through our secure third-party payment processor (Stripe). Hosts authorize Hostasks to charge their payment method for booked services. Cleaners receive payment within 3-5 business days after job completion.
6.2 Cancellation and Refunds
Cancellation policies vary based on timing. Hosts may cancel up to 24 hours before a scheduled cleaning for a full refund. Cancellations within 24 hours may be subject to a cancellation fee. Cleaners who cancel jobs may have their reliability rating affected.
6.3 Disputes
Payment disputes must be reported within 48 hours of service completion. Hostasks will review disputes and may mediate between parties. Final decisions on refunds are at Hostasks' discretion.
7. Booking and Scheduling
7.1 Booking Process
Hosts can browse Cleaner profiles, view ratings and reviews, and request bookings through the platform. Cleaners have the right to accept or decline booking requests based on their availability and preferences.
7.2 Confirmed Bookings
Once a Cleaner accepts a booking request, it becomes a confirmed booking. Both parties are expected to honor confirmed bookings. Repeated cancellations or no-shows may result in account penalties or termination.
7.3 Communication
All communication between Hosts and Cleaners should occur through the Hostasks platform. This helps protect both parties and allows Hostasks to assist with any disputes.
8. Reviews and Ratings
After each completed service, both Hosts and Cleaners may leave reviews and ratings. Reviews should be honest, fair, and based on actual experiences. Hostasks reserves the right to remove reviews that violate our community guidelines, including reviews that contain:
- Discriminatory or offensive language
- False or misleading information
- Personal attacks or harassment
- Content unrelated to the service provided
- Promotional content or spam
9. Prohibited Conduct
Users agree not to engage in any of the following prohibited activities:
- Circumventing the platform to avoid fees or conduct transactions outside of Hostasks
- Providing false, misleading, or inaccurate information
- Harassing, threatening, or discriminating against other users
- Violating any applicable laws or regulations
- Using the platform for any illegal or unauthorized purpose
- Attempting to gain unauthorized access to the platform or other users' accounts
- Interfering with or disrupting the platform's operation
- Soliciting personal information from other users for purposes unrelated to services
10. Intellectual Property
The Hostasks platform, including its design, features, content, and code, is owned by Hostasks, LLC and protected by intellectual property laws. Users may not copy, modify, distribute, or create derivative works based on our platform without explicit permission.
By posting content on Hostasks (such as profile information, photos, or reviews), you grant Hostasks a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with operating and promoting the platform.
11. Privacy
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Hostasks, you consent to our collection and use of your information as described in the Privacy Policy.
12. Disclaimers
THE HOSTASKS PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HOSTASKS DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. HOSTASKS IS NOT RESPONSIBLE FOR THE CONDUCT, QUALITY, OR LEGALITY OF ANY CLEANER'S SERVICES OR ANY HOST'S PROPERTY OR BEHAVIOR. USERS ENGAGE WITH EACH OTHER AT THEIR OWN RISK.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTASKS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM OR ANY SERVICES OBTAINED THROUGH THE PLATFORM.
HOSTASKS' TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO HOSTASKS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify, defend, and hold harmless Hostasks, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.
15. Dispute Resolution
15.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact Hostasks at help@hostasks.com to attempt to resolve any dispute informally.
15.2 Arbitration
If informal resolution is unsuccessful, any disputes arising from these Terms or your use of the platform shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. Arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.
15.3 Class Action Waiver
You agree to resolve disputes with Hostasks on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
16. Termination
Hostasks may suspend or terminate your account at any time for any reason, including violation of these Terms, without prior notice. You may also terminate your account at any time by contacting us.
Upon termination, your right to use the platform will immediately cease. Provisions of these Terms that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) will survive.
17. Changes to Terms
Hostasks reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the platform after changes become effective constitutes acceptance of the revised Terms.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Hostasks regarding your use of the platform.
